California Bbs Adds Telehealth Ce Requirement For Everyone New Law And Ethics Ce Requirement For Associates
California Governor Gavin Newsom on Sunday signed Assembly Bill 1759, making a couple of key changes in continuing education requirements for California MFTs, clinical counselors, and clinical social workers. Theres a new one-time Telehealth CE requirement for everyone, and a new annual Law and Ethics CE requirement for Associates.

Putting Together A Study Plan
The California Law and Ethics Exam may seem overwhelming, but with time, hard work, and the right materials, success is within reach! Before you begin studying, its important that you understand what will be covered, so that you can put together a study plan to guide you through the process.
The California Law and Ethics Exam consists of 75 multiple-choice questions and test-takers are given 90 minutes to complete the exam. 40% of the exam covers legal issues and 60% of the exam assesses the test-takers ability to apply ethical standards to clinical situations. The exam assesses your knowledge of confidentiality, privilege, consent, mandated reporting, professional practice, professional competence, managing therapeutic relationships, and business practices and policies.
To prepare for this exam, first take the time to put together a study plan. This plan should incorporate content review , as well as question-based practice. Once you have completed most of your content review, it is time to take full-length practice exams. Dont forget that the greatest value comes from reviewing and analyzing your results afterwards.

Law & Ethics Ce For All Associates
Under current law, Associates who fail their Law & Ethics Exam and then renew their registrations prior to their next exam attempt must complete a 12-hour CE course in Law and Ethics before that next attempt. Its a confusing requirement, and one that has caused headaches for many of those who dont pass that test on their first try.
As of January 1, 2023, all California BBS associates must complete 3 hours of continuing education in Law and Ethics in each year of their associate registration. The requirement for some to take a 12-hour CE course to be eligible for re-examination will be removed.

What Is The Law And Ethics Exam
The California Law and Ethics Exam is a 90-minute, 75 question test that was created to ensure that unlicensed Social Workers, Marriage and Family Therapists, and Clinical Counselors understand the specific laws and ethics that govern clinical practice. Only 50 of the 75 questions are scored the remaining 25 questions are pre-test items included to measure their effectiveness for use on future exams. Passing the Law and Ethics Exam is required in order to obtain your license as an LCSW, LMFT or LPCC in the state of California.

Law And Ethics Examination Information
After you file your application for the law and ethics examination you will be sent information from PSI on how to separately pay for and schedule the required computerized written examination. You will then be able to schedule the written examination at your convenience.
If your Law and Ethics Examination Application is currently on file with the Board, your eligibility has been forwarded to PSI. You will receive an information package by mail with information regarding scheduling and testing procedures.
Pursuant to Business and Professions Code 1004: Abandonment of Applications
- An application shall be deemed to have been abandoned in any of the following circumstances:
- The applicant fails to submit the application, examination, or reexamination fee within 180 days after notification by the board that such fee is due and unpaid.
- The applicant fails to take the licensing examination within two years after the date his or her application was received by the board.
- Except as provided in paragraph of this subdivision, the applicant, after failing the examination, fails to take a reexamination within two years after the date the applicant was notified of such failure
- The Registered Dental Assistant in Extended Functions applicant, after failing either the clinical or practical component of the examination, fails to take a reexamination of the failed component within two years after the date the applicant was notified of such failure.

The California Law and Ethics Exam contains 75 questions, 25 of which are experimental, and do not count towards your final score.
Upon completion of the Law and Ethics Exam, candidates will receive a pass or fail. Candidates who have failed will receive a score report that includes a numeric score and other diagnostic information. Passing scores will vary by exam cycle and the Board of Behavioral Sciences does not release information about what score is required to pass.
Test-takers who answer 70% of the questions correctly have a good chance at receiving a passing score.

Should You Do A Prep Course
A number of providers offer prep courses for the exam, either in person or online. A prep course can be useful if it helps you feel more prepared and confident going in to your exam. But the scope of knowledge on the law and ethics test is fairly limited. In addition, because you must take the test in your first year after registering as an associate, your legal and ethical knowledge is likely already fairly up to date. So many examinees will not need to spend hundreds of dollars on a prep course to prepare themselves for this test. Our study guide can be all you need.

Take It As Part Of The Renewal Process
Its understandable why a lot of folks put off their tests. As a new Associate, your primary focus can easily be on finding a job. Once you have that job, its easy to get into a routine of focusing on client care, supervision, and whatever else the job entails. Your job probably doesnt give you the luxury of several hours a day to study for a test and also, you just finished grad school! Its okay to want a break from testing.
But dont wait too long. You would miss out on those benefits that come with taking the exam early. And far too many associate MFTs, PCCs, and CSWs wait until the very, very end of that first year to take the test. They often suffer for it. You need to plan at least some time for the simple logistics of the test. It takes couple of weeks for your application for exam eligibility to process. It will likely take at least a few more days to schedule the test at a convenient time and location for you to actually take the exam. And then it takes a couple of days for PSI to send your test results back to the BBS, and for the BBS to update their system.
If you dont adequately plan for these logistical delays, you might find that your registration number lapses. At that point, in many work settings you can no longer see clients under California law. You must attempt the test and renew your registration to resume clinical work.

Take It As Early As Possible
There are three big benefits to this approach. One, your legal and ethical knowledge should still be fresh from graduate school. Two, assuming you pass, youll have a meaningful stressor out of the way. Third and perhaps most importantly, if you take the test early enough in your first year of registration, failing is basically inconsequential. You just need to wait 90 days, and try again. You dont need to take a CE course to attempt the test again unless you renewed your registration in between exam attempts.
